SHOOT AN AMERICAN ENEMY CONTEST OFFICIAL RULES

THIS CONTEST IS ONLY OPEN TO SHAREHOLDERS OF ARMED FORCES BREWING COMPANY INC. (“SHAREHOLDER” OR “SHARHOLDERS”) WHO HAVE RESERVED THEIR FREE TICKETS TO RALLY POINT 2024 AS OF OCTOBER 1, 2024 – THE DATE OF THE RANDOM DRAWING.

ONCE A PERSON HAS APPLIED TO PURCHASE SHARES, HAS PAID FOR THE SHARES, HAS COMPLETED COMPLIANCE AND HAS BEEN ISSUED SHARES, THAT PERSON BECOMES A SHAREHOLDER. AT THAT POINT, THE SHAREHOLDER MUST HAVE RESERVED A FREE TICKET TO RALLY POINT 2024 THROUGH TICKETSOURCE TO BE ELIGIBLE FOR THE RANDOM DRAWING. 

THE ONLY SHAREHOLDERS WHOSE NAMES WILL BE INCLUDED IN THE RANDOM DRAWING WILL BE THOSE SHAREHOLDERS WHOSE NAMES APPEAR ON THE LIST OF RESERVED TICKETS IN THE TICKETSOURCE DATABASE.

NO PURCHASE IS NECESSARY FOR A SHAREHOLDER ATTENDING RALLY POINT TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. Eligibility: This contest is open only to Shareholders of Armed Forces Brewing Company Inc. (“Shareholder” or “Shareholders”) who have reserved their free tickets to Rally Point 2024 as of October 1, 2024 – the date of the random drawing.

Once a person has applied to purchase shares, has paid for the shares, has completed compliance and has been issued shares, that person becomes a Shareholder. At that point, the Shareholder must have reserved a free ticket to Rally Point 2024 through TicketSource to be eligible for the random drawing.  Each Shareholder will be entitled to one entry in the Contest, regardless of the number of tickets to Rally Point purchased or received by said Shareholder.

The only Shareholders whose names will be included in the random drawing on October 1, 2024 will be those Shareholders whose names appear on the list of reserved tickets in the TicketSource database.

2. Age: You must be 21 years of age or older as of the date of entry.

3. The contest is only open to legal residents of the United States and is void where prohibited by law.

4. Employees of Armed Forces Brewing Company Inc., its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Employees”), and immediate family members and/or those living in the same household of Employees are not eligible to participate in the contest.

5. The contest is subject to all applicable federal, state, and local laws and regulations, as well as international laws applicable in the country of residence of the Shareholder. Void where prohibited.

6. Agreement to Rules: By participating, a contestant (“You”) agree to be fully unconditionally bound by these Official Rules, and You represent and warrant that You meet the eligibility

requirements. In addition, You agree to accept the decisions of Armed Forces Brewing Company Inc. as final and binding as it relates to the content of this contest.

7. How to Enter: Entries into the contest will be determined by Armed Forces Brewing Company Inc. based on Shareholders who have reserved at least one ticket to Rally Point 2024 in the TicketSource ticketing system.  At 5:00 PM on October 1, 2024, no further Shareholders will be included in the contest, and Armed Forces Brewing Company Inc. will create the final list of Shareholders eligible for the contest at that time. A random drawing will be held and two Shareholders will be selected and notified within 48 hours.

8. Prizes: There are only two prizes offered as part of this Contest.  Two Shareholders selected in a random drawing (hereinafter “Winner” or “Winners”) as set out herein will each receive one (1) invitation to attend the Shoot An American Enemy event on October 18, 2024 at Freedom Outdoors,  5070 Virginia Beach Blvd Virginia Beach, VA our brewery in Norfolk, Virginia. Should one or both Winners selected be unable or unwilling to attend the event, Armed Forces Brewing Company Inc. reserves the right, but not the obligation, to hold an additional random drawing or additional random drawings to find a replacement or two replacement contest Winners.

Travel arrangements and expenses including but not limited to airfare, lodging, ground transportation to and from the event are not included.

The value of each prize is less than $5,000.00  The specifics of the prizes shall be solely determined by Armed Forces Brewing Company Inc. No cash or other prize substitution shall be permitted except at Armed Forces Brewing Company Inc.’s discretion. The prizes is

nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of each winner. Winners agree that Armed Forces Brewing Company Inc. may send each Winner a Form 1099 with respect to the prize award. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by any Winner is permitted. Acceptance of prize constitutes permission for Armed Forces Brewing Company Inc. to use Winner’s name, likeness, video, photograph and entry for purposes of advertising, marketing and trade without further compensation unless prohibited by law.

9. Odds: The odds of winning depend on the number of eligible entries received.

10. Winner Selection and Notification: Two Winners will be selected by a random drawing under the supervision of Armed Forces Brewing Company Inc. Winners will be notified by email or telephone or text message within three days following selection.  Armed Forces Brewing Company Inc. shall have no liability for Winner’s failure to receive notices due to spam, junk e-mail or other security settings or for Winner’s provision of incorrect or otherwise non-functioning contact information. If Winner cannot be contacted, is ineligible, fails to claim the prize within 24 hours from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected in Armed Forces Brewing Company Inc.’s complete and ultimate

discretion. Receipt by Winner of the prize offered in this Campaign is conditioned upon compliance with any and all federal, state, international and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT ARMED FORCES BREWING COMPANY INC.’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

11. Location of Drawing: Drawing will be held at the headquarters of Armed Forces Brewing Company Inc. unless otherwise determined by Armed Forces Brewing Company Inc. management in their complete and absolute discretion.

12. Rights Granted by You: By entering this content (e.g., photo, video, text, etc.), You understand and agree that Armed Forces Brewing Company Inc., anyone acting on behalf of Armed Forces Brewing Company Inc., and Armed Forces Brewing Company Inc.’s licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity

and throughout the world, without limitation, your entry, name, photograph, likeness, video and statements about the event and your participation in the event, for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

13. Terms & Conditions: Armed Forces Brewing Company Inc. reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the contest for any reason whatsoever, including but not limited to, should virus, bug, non-authorized human intervention, fraud, or other cause beyond Armed Forces Brewing Company Inc.’s control corrupt or affect the administration, security, fairness, or proper conduct of the contest. In such case, Armed Forces Brewing Company Inc. may select the Winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Armed Forces Brewing Company Inc. Armed Forces Brewing Company Inc. reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the contest or

website or violates these Official Rules. Armed Forces Brewing Company Inc. has the right, in its sole discretion, to maintain the integrity of the contest, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by contest rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the contest may be a violation of criminal and civil laws. Should such attempt be made, Armed Forces Brewing Company Inc. reserves the right to seek damages or otherwise take legal action to the fullest extent permitted by law.

14. Limitation of Liability: By entering, You agree to release and hold harmless Armed Forces Brewing Company Inc. and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the contest; (v) electronic or human error in the administration of the  the processing of entries.

15. Disputes: THIS CONTEST IS GOVERNED BY THE LAWS OF VIRGINIA. As a condition of participating in this contest, participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this contest, shall be resolved individually, without resort to any form of class action. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this contest). Participant further waives all rights to have damages multiplied or increased.
